This website, x58cartel.com, is operated by x58cartel ("x58cartel," "we," "us," and "our"), a California-based retailer. By visiting our site or purchasing something from us, you use our "Service" and agree to these Terms of Service ("Terms"), including the additional policies referenced here: our Return & Refund Policy, Shipping Policy, and Privacy Policy. These Terms apply to everyone who uses the site, including browsers, customers, and contributors of content.

Please read these Terms carefully before using our site. If you don't agree with all of them, you may not use the site or buy from us. Any new features or products added to the store are also subject to these Terms. We may update these Terms by posting changes on this page; your continued use of the site after a change means you accept it.

Our store is hosted on Shopify Inc., which provides the e-commerce platform that lets us sell our products to you.

Section 1 – Emissions and off-road use disclaimer

Unless a product listing explicitly states that a part carries a CARB Executive Order (EO) number or is otherwise certified for street use, all performance parts sold by x58cartel are intended for competition or off-road use only and may not be legal for use on public roads or on pollution-controlled vehicles in California or other states and countries that have adopted California emissions standards. This includes, without limitation, intakes, charge pipes, downpipes, mid-pipes, turbochargers, tunes, and fueling components.

It is your responsibility to check all applicable federal, state, local, and environmental laws before ordering and installing a product. x58cartel does not confirm, implicitly or explicitly, the legality of using any product on public roads, and is not responsible for any fees, fines, failed inspections, or other costs you incur as a result of installing or using a product in violation of those laws.

Section 2 – Fitment and installation

Vehicle applications listed on our product pages are provided in good faith from manufacturer data. Fitment can vary by production date, market, option package, and prior modifications. You are responsible for confirming that a part fits your vehicle before ordering. If you're unsure, contact us with your VIN and we'll help confirm fitment before you buy.
Performance parts should be installed by a qualified technician following the manufacturer's instructions. x58cartel is not responsible for damage, injury, or loss caused by improper installation, use with incompatible parts, or use beyond the manufacturer's stated limits.
Installing aftermarket parts, or flashing an engine or transmission control unit, may affect or void your vehicle manufacturer's warranty. You accept that risk.

Section 3 – Online store terms

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence. You may not use our products for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction. You must not transmit any worms, viruses, or code of a destructive nature. A breach of any of the Terms will result in immediate termination of your access to the Service.

Section 4 – General conditions

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including payment card information) may be transferred unencrypted and involve transmissions over various networks and changes to conform to the technical requirements of connecting networks or devices. Payment card information is always encrypted during transfer. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without our express written permission. The headings in these Terms are for convenience only and don't limit or affect them.

Section 5 – Accuracy, completeness, and timeliness of information

We're not responsible if information on this site isn't accurate, complete, or current. The material on this site, including technical articles and installation resources, is provided for general information only and shouldn't be relied on as the sole basis for decisions without consulting primary sources such as the manufacturer's own documentation. Any reliance on the material on this site is at your own risk. We reserve the right to modify the contents of this site at any time but have no obligation to update any information.

Section 6 – Products, pricing, and availability

Prices are in US dollars and are subject to change without notice. Many of our brands set minimum advertised prices; where that's the case, the price shown is the lowest we can advertise.
We reserve the right to modify or discontinue any product at any time without notice, and to limit the quantities of any product we offer. We may limit or refuse sales to any person, region, or jurisdiction on a case-by-case basis.
Product images and colors are shown as accurately as possible, but we can't guarantee that your screen's display of any color or finish will be accurate. Images may show a related variant or a part installed with other modifications.
Most items ship directly from the manufacturer or our distributor. Availability shown on the site is updated regularly but isn't guaranteed; if an item you ordered is unavailable, we'll contact you with the expected date and the option to wait, substitute, or cancel for a full refund.
Returns and exchanges are governed by our Return & Refund Policy, and delivery by our Shipping Policy.

Section 7 – Warranty

Products sold by x58cartel are covered by the manufacturer's warranty, where one is offered, under the manufacturer's own terms, which vary by brand. x58cartel does not provide a separate warranty. To make a claim, contact us with your order number and a description of the defect; we'll help you file the claim with the manufacturer. Warranties generally don't cover damage caused by improper installation, modification, racing or competition use, abuse, neglect, or use with incompatible parts, and the manufacturer may refuse a claim on that basis. Labor, towing, downtime, and consequential costs aren't covered.

Section 8 – Tunes, software, and digital products

Flash-tool licenses, tunes, and software (including MHD, bootmod3, and JB4 products) are licensed by their respective developers under the developer's own license terms, are tied to your VIN or device once activated, and are non-refundable once issued or downloaded. You're responsible for providing an accurate VIN and email address. x58cartel doesn't develop these products and isn't responsible for their performance, compatibility with future vehicle software updates, or any effect on your vehicle's warranty or emissions compliance.

Section 9 – Accuracy of billing and account information

We reserve the right to refuse any order you place with us, and may limit or cancel quantities purchased per person, per household, or per order, including orders that appear to be placed by dealers, resellers, or distributors. If we change or cancel an order, we'll try to notify you at the email or phone number you provided. You agree to provide current, complete, and accurate purchase and account information for all purchases, and to keep it updated so we can complete your transactions and contact you as needed.

Section 10 – Optional tools and third-party links

We may provide access to third-party tools we don't monitor or control, provided "as is" and "as available" without warranties of any kind. Certain content, products, and services available via our Service, including installation guides, videos, and vendor forum links, may include materials from third parties. Links to third-party sites aren't an endorsement; we aren't responsible for their content or accuracy and have no liability for any transactions you make on them. Please review the third party's policies before engaging in any transaction.

Section 11 – User comments, feedback, and submissions

If you send us comments, suggestions, reviews, photos, or other materials, whether at our request or not, you agree that we may edit, copy, publish, distribute, and otherwise use them in any medium without restriction, compensation, or obligation of confidentiality. We may, but aren't obligated to, monitor, edit, or remove content we determine is unlawful, offensive, defamatory, obscene, or otherwise objectionable, or that violates anyone's intellectual property or these Terms. You agree your submissions won't violate any third-party right, won't contain unlawful or abusive material or malware, and won't misrepresent who you are. You're solely responsible for your submissions and their accuracy.

Your submission of personal information through the store is governed by our Privacy Policy.

Section 13 – Errors, inaccuracies, and omissions

Occasionally there may be information on our site that contains typographical errors, inaccuracies, or omissions relating to product descriptions, fitment, pricing, promotions, shipping charges, transit times, or availability. We reserve the right to correct any such errors, and to change or update information or cancel orders if any information is inaccurate, at any time without prior notice, including after you've submitted your order. If we cancel an order for a pricing error, you'll receive a full refund.

Section 14 – Prohibited uses

In addition to the other prohibitions in these Terms, you may not use the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform unlawful acts; (c) to violate any international, federal, state, or local regulation, rule, law, or ordinance; (d) to infringe our intellectual property rights or those of others; (e) to harass, abuse, insult, harm, defame, slander, intimidate, or discriminate; (f) to submit false or misleading information; (g) to upload or transmit viruses or other malicious code; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service. We may terminate your use of the Service for violating any of these.

Section 15 – Disclaimer of warranties; limitation of liability

We don't guarantee that your use of our Service will be uninterrupted, timely, secure, or error-free, or that the results obtained from the Service will be accurate or reliable. We may remove the Service for indefinite periods or cancel it at any time without notice.

You expressly agree that your use of, or inability to use, the Service is at your sole risk. Except as expressly stated by us or by the applicable manufacturer's warranty, the Service and all products delivered through it are provided "as is" and "as available," without any representation, warranty, or condition of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall x58cartel, its owners, directors, officers, employees, affiliates, agents, contractors, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including lost profits, lost revenue, loss of use, vehicle damage, replacement costs, or similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of the Service or any product purchased through it, even if advised of the possibility. Our total liability for any claim relating to a product is limited to the amount you paid us for that product. Because some states or jurisdictions don't allow the exclusion or limitation of liability for consequential or incidental damages, in those jurisdictions our liability is limited to the maximum extent permitted by law.

Section 16 – Indemnification

You agree to indemnify, defend, and hold harmless x58cartel and its owners, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms or the documents they incorporate by reference, your violation of any law or the rights of a third party, or your installation or use of any product purchased from us.

Section 17 – Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law and the unenforceable portion severed, without affecting the validity and enforceability of the remaining provisions.

Section 18 – Termination

The obligations and liabilities of the parties incurred before the termination date survive termination. These Terms are effective unless and until terminated by you or us. You may terminate them at any time by notifying us that you no longer wish to use our Service or by ceasing to use the site. If, in our sole judgment, you fail to comply with any term of these Terms, we may terminate this agreement at any time without notice; you remain liable for all amounts due through the date of termination, and we may deny you access to the Service.

Section 19 – Entire agreement

Our failure to exercise or enforce any right or provision of these Terms isn't a waiver of it. These Terms and any policies or operating rules we post on this site constitute the entire agreement between you and us and govern your use of the Service, superseding any prior agreements, communications, or proposals, oral or written. Any ambiguities in these Terms won't be construed against the drafting party.

Section 20 – Governing law and disputes

These Terms and any separate agreements under which we provide you the Service are governed by and construed in accordance with the laws of the State of California and the federal laws of the United States applicable therein, without regard to conflict-of-law principles. Any dispute arising out of these Terms or your purchase will be brought in the state or federal courts located in Orange County, California, and you consent to the jurisdiction of those courts, except that either party may bring an individual claim in small claims court.

Section 21 – Price matching and discount codes

Price matching, when offered, is at our discretion, handled case by case, and may not apply to all brands, in particular brands with minimum advertised pricing. Discount codes we issue are subject to change at short notice, may exclude specific brands or products, and can't be combined with other offers unless stated. We reserve the right to decline a price-match request or discount code as we see fit.

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates and changes to our website.
